  1. END USER LICENSE AGREEMENT FOR HOLLYWOOD BLOOPERS MULTIMEDIACLIPS

  3. SIMITAR SOFTWARE MULTIMEDIACLIPS LICENSE

  5. Copyright 1993-1994 Simitar Software. All Rights Reserved.

  7. United States copyright law and international copyright treaties protect these
  8. MultimediaClips images. Simitar Software depended on the availability of this
  9. protection when it decided to spend the time and money required to produce these
  10. MultimediaClips images. Nevertheless, Simitar Software realizes that you have
  11. licensed this copy of the images so that you could copy the images in their
  12. present or a modified form and incorporate them into another work.

  14. Simitar Software therefore gives you permission to copy and modify
  15. MultimediaClips images for your own use. MultimediaClips images may not be
  16. distributed as part of any software product or as part of an electronic document
  17. or collection of documents without written permission from Simitar Software.
  18. Simitar Software, however, gives you permission to incorporate and distribute
  19. duplicate or modified MultimediaClips images as an incidental part of any
  20. product or collection of products which are distributed commercially (i.e.,
  21. distributed for profit, such as a newsletter); provided the use or distribution
  22. of any MultimediaClips images does not constitute a substantial portion of the
  23. value of the goods distributed commercially. For example, you may not, without
  24. written permission from Simitar Software, use a MultimediaClips images as an art
  25. image on a T shirt or poster manufactured for resale. You may not make any
  26. copies of any portion of the MultimediaClips images library for distribution or
  27. resale. Except as specifically stated above, you may not copy, modify, or
  28. distribute MultimediaClips images.

  30. Simitar Software grants you this license for a single CPU (central processing
  31. unit) only. This software may not be loaded onto a Local Area Network unless a
  32. license has been purchased for each CPU on the Network. Please call or
  33. write Simitar Software for more details regarding Network Licenses and Site
  34. Licenses.
  35.  
  36. Please write Simitar Software if you wish to obtain a license to distribute
  37. duplicate or modified MultimediaClips images other than expressly permitted
  38. under this license, or if you have any questions concerning your rights.
  39.  
  40. LIMITED WARRANTY
  41.  
  42. Simitar Software warrants to you, the original Licensee, that the
  43. MultimediaClips images are substantial in conformance with the visual index
  44. manual for a period of 90 days from the date of purchase. If a disk is
  45. defective, Simitar Software will replace the disk at no charge to you, if you
  46. return the disk to Simitar Software at the address below with proof of purchase
  47. within 90 days after you purchased it. Your sole and exclusive remedy, and
  48. Simitar Software's sole and exclusive liability, will be either replacement of
  49. the disk or a refund of the purchase price in accordance with this limited
  50. warranty.

  52. THE ABOVE WARRANTY IS THE ONLY WARRANTY OR REPRESENTATION OF ANY KIND WITH
  53. RESPECT TO MULTIMEDIACLIPS IMAGES MADE BY SIMITAR SOFTWARE OR ANYONE ELSE
  54. INVOLVED IN THE CREATION, PRODUCTION, DELIVERY, OR LICENSING OF MULTIMEDIACLIPS
  55. IMAGES. FURTHERMORE, ANY IMPLIED WARRANTIES WITH RESPECT TO MULTIMEDIACLIPS
  56. IMAGES DISKS/CD-ROMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
  57. FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD PARTY RIGHTS, ARE
  58. SPECIFICALLY DISCLAIMED.

  60. NEITHER SIMITAR SOFTWARE NOR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION,
  61. DELIVERY, OR LICENSING OF MULTIMEDIACLIPS IMAGES MAKES ANY WARRANTY OR
  62. REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO MULTIMEDIACLIPS
  63. IMAGES OR THEIR QUALITY, RELIABILITY, OR PERFORMANCE, OR THEIR MERCHANTABILITY
  64. OR FITNESS FOR ANY PARTICULAR PURPOSES. MULTIMEDIACLIPS IMAGES ARE LICENSED "AS
  65. IS. " YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, RELIABILITY, AND PERFORMANCE
  66. OF THE IMAGES. IF THE MULTIMEDIACLIPS IMAGES PROVE DEFECTIVE, YOU, AND NOT
  67. SIMITAR SOFTWARE OR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY,
  68. OR LICENSING OF MULTIMEDIACLIPS IMAGES, MUST ASSUME THE ENTIRE COST OF ALL
  69. NECESSARY CORRECTIONS.

  71. DISCLAIMER OF DAMAGES
  72.  
  73. IN NO EVENT WILL SIMITAR SOFTWARE OR ANYONE ELSE INVOLVED IN THE CREATION,
  74. PRODUCTION, DELIVERY, OR LICENSING OF MULTIMEDIACLIPS IMAGES BE LIABLE TO YOU
  75. FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, DIRECT, OR INDIRECT DAMAGES OF ANY
  76. KIND ARISING OUT OF THE USE OF MULTIMEDIACLIPS IMAGES OR ANY DEFECT IN THE
  77. MULTIMEDIACLIPS IMAGES, EVEN IF SIMITAR SOFTWARE OR ANYONE ELSE INVOLVED IN THE
  78. CREATION, PRODUCTION, DELIVERY, OR LICENSING OF MULTIMEDIACLIPS IMAGES HAS BEEN
  79. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  81. This notice will be construed, interpreted, and governed by the laws of the
  82. state of Minnesota as applied to transactions taking place entirely within
  83. Minnesota between Minnesota residents. Should you have any questions concerning
